Terms of Service
These Terms of Service (“Terms”) govern access to and use of the MAVORS platform (“Service”), provided by Atiempo.Me SL (“MAVORS”, “we”). The Service is offered exclusively to businesses (B2B) and is not intended for consumers. By creating an account or subscribing to the Service, the contracting business (“Customer”, “Tenant”) accepts these Terms.
1. Nature of the service
MAVORS is a software-as-a-service platform that helps service companies manage intake, quotes, scheduling, field execution, invoicing and recurring maintenance plans. MAVORS licenses the use of the platform; it does not operate, manage or take responsibility for the Tenant's own business.
2. Tenant independence and liability separation
The Tenant is an independent company that uses the Service to operate its own business. The Tenant is solely responsible for: the services and goods it sells; its contracts, quotes, prices and invoices toward its own clients; the collection of payments from its clients; and its own tax, accounting and regulatory obligations. Atiempo.Me SL is not a party to any contract, transaction or dispute between the Tenant and the Tenant's clients, does not act as merchant of record for the Tenant's sales, and accepts no liability arising from them.
3. Account and registration
The Tenant must provide accurate registration information and is responsible for the confidentiality of its account credentials and for all activity under its account.
4. Subscription, fees and payment
Access to the Service is provided under a subscription plan. During private early access, pricing is provided individually and confirmed in writing before billing begins. Fees are billed in accordance with the Tenant's subscription plan and are exclusive of applicable taxes unless stated otherwise.
5. Refunds
Subscription fees already invoiced are generally non-refundable. On termination during a paid period, MAVORS may, at its discretion or as agreed in a signed order form, refund the unused portion of the period on a pro-rata basis.
6. Suspension and termination
MAVORS may suspend or terminate access to the Service for non-payment, breach of these Terms, or conduct that risks the security or integrity of the platform, upon notice where reasonably possible. Either party may terminate the subscription in accordance with the agreed notice period.
7. Early access and availability disclaimer
The Service is currently offered as a private early access product to a limited number of pilot companies. It is provided without an uptime service-level agreement, and features, availability and pricing may change substantially before general availability. The Tenant acknowledges the early-access nature of the Service when subscribing during this period.
8. Intellectual property
MAVORS and its licensors retain all rights, title and interest in the platform, its software and its documentation. The Tenant retains all rights in its own business data entered into the platform.
9. Data protection
Processing of personal data that the Tenant enters into the platform is governed by the Data Processing Agreement, which forms part of these Terms.
10. Limitation of liability
To the maximum extent permitted by law, Atiempo.Me SL's aggregate liability arising from or related to the Service is limited to the fees paid by the Tenant for the Service during the period preceding the event giving rise to the claim, as set out in the applicable order form. Neither party is liable for indirect, incidental or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law, nor MAVORS' obligations as a data processor under the DPA.
11. Confidentiality
Each party will protect the other's confidential information and use it only to perform its obligations under these Terms.
12. Term and termination effects
Upon termination, the Tenant's right to access the Service ends; data export and deletion are handled as described in the Data Processing Agreement.
13. Governing law and jurisdiction
These Terms are governed by Spanish law. Any dispute shall be submitted to the courts of Málaga.
14. Changes to these terms
We may update these Terms as the Service evolves during early access and beyond; material changes will be communicated to active Tenants in advance.
